Important — new eligibility rules are in force. Federal legislation that came into force in March 2026 (the Strengthening Canada's Immigration System and Borders Act, formerly Bill C-12) added new grounds on which a refugee claim may be found ineligible for referral to the IRB — including claims made more than one year after a person's first entry into Canada (for entries after June 24, 2020) and certain claims made after entering between ports of entry along the Canada–U.S. land border. These rules apply to claims made on or after June 3, 2025, and affected people may instead be directed to a Pre-Removal Risk Assessment (PRRA). Whether and how these rules affect your situation must be assessed individually — get professional advice before deciding your next step.

Common Mistakes in Refugee Claims

Refugee claims are often decided on credibility and consistency. In our experience, and in published IRB and Federal Court decisions, the same problems appear again and again:

  • Unclear timeline — dates and sequences of events that shift between documents
  • Emotional story without evidence — a genuine fear presented without supporting documents
  • Contradictions — differences between the BOC, other forms, port-of-entry notes, and testimony
  • Weak supporting documents — irrelevant, unverifiable, or poorly explained evidence
  • Late preparation — starting to prepare for the hearing only days before it happens
  • Not understanding hearing questions — answering a different question than the one asked

A mistake does not automatically end a claim — but preventing these problems early is far easier than explaining them later.

Refugee Claim FAQ

A refugee claim is a request for protection made from inside Canada by a person who fears persecution, torture, risk to life, or cruel and unusual treatment or punishment in their country. Eligible claims are referred to the Refugee Protection Division of the Immigration and Refugee Board of Canada (IRB), an independent tribunal, which normally decides the claim after a hearing. Each case is decided individually on the evidence.

You are not required to have a representative, but the Basis of Claim (BOC) form is one of the most important documents in the claim. Its narrative, dates, and details are compared with your other forms, documents, and testimony. Many claimants choose to work with an authorized representative — a licensed RCIC-IRB or a lawyer — before submitting the BOC, so the timeline is clear, consistent, and supported by evidence.

At a Refugee Protection Division hearing, an IRB member reviews your file and asks questions about your identity, your story, and your evidence. The member tests whether the claim is credible and whether it meets the legal definitions of a Convention refugee or a person in need of protection. Interpreters are available, and an authorized representative may attend and make submissions where applicable.
